When a product subject to mandatory certification is imported into Brazil, the certification must be issued in the name of a Brazilian legal entity. In this context, our company may act as the Legal Representative and Certificate Holder before the Instituto Nacional de Metrologia, Qualidade e Tecnologia (INMETRO).
By holding the certification in Brazil, RAGB acts as Legal Representative, including:
Regulatory Accountability
The certificate holder becomes legally responsible for the product’s compliance with applicable Brazilian Technical Regulations (RTQ/RAC).
Liaison with the Certification Body (OCP)
The representative coordinates all interactions with the accredited Product Certification Body (OCP), including documentation review, audits, testing procedures, and certification maintenance.
Annual Audit of the Brazilian Legal Representative (SAC Verification)
As the Certificate Holder in Brazil, our company is subject to annual audits to verify the proper implementation and maintenance of the Customer Service System (SAC) and related compliance procedures within Brazilian territory. These audits assess whether post-market obligations, traceability, complaint handling, and regulatory responsibilities are being properly managed in accordance with INMETRO requirements.
Some audits are presential, and in that case, all charges must be reimbursed to the auditing company by our company.
Certification Maintenance, Updates, and Regulatory Management
Annual maintenance processes must be formally conducted and duly reported to the Instituto Nacional de Metrologia, Qualidade e Tecnologia (INMETRO). Our company manages the entire maintenance cycle, ensuring deadlines are met and documentation is properly submitted.
Additionally, any product changes — including the inclusion or exclusion of models within the certification scope — must be formally processed. We coordinate and manage these updates with the Certification Body, ensuring continuous compliance and uninterrupted market authorization.
Market Surveillance and Corrective Actions
If any non-conformity is identified through market surveillance, the certificate holder is responsible for implementing corrective actions, including, if necessary, product recalls in accordance with Brazilian regulations.
Control of the INMETRO Conformity Mark
The use of the INMETRO conformity seal must strictly follow regulatory requirements. The Legal Representative ensures proper labeling and traceability.
